外国人雇用状況の届出の義務化平成19年10月1日より、すべての事業主には外国人労働者(特別永住者および在留資格[外交]・[公用]の者を除く)の雇い入れまたは離職の際に、当該外国人の労働者の氏名、在留資格、在留期間等を、ハローワークを通じ厚生労働大臣へ届けることが義務づけられます。
(1) 雇用保険の被保険者である外国人に係る届出
雇用保険の被保険者資格の取得届または喪失届の備考欄に、在留資格、在留期限、
国籍等を記載して届出。
(2) 雇用保険の被保険者ではない外国人に係る届出
外国人雇用状況届出書に氏名、在留資格、在留期限、生年月日、性別、国籍等を記
載して届出。
届出期限は雇い入れ、離職の場合ともに翌月末日まで。
10月1日時点で既に雇用している外国人労働者については、施工後1年の間(平成
20年10月1日まで)に届出。
・報告書の提出を怠ったり、虚偽の届出を行った場合には、30万円以下の罰金が課せられます。
Compulsory Notification of Foreign Nationals Employed in JapanBeginning October 1, 2007, all employers must file a notification with the Minister of Health, Labor and Welfare through the Public Employment Security Office (Hello Work) upon employment and/or departure of a foreign employee (excluding those who hold special permanent residency or who have diplomatic or official status). The notification should include information such as the foreign employees’ names, residency status, and duration of stay.
(1) Notification on Foreign Nationals covered by Employment Insurance
Indicate the residency status, duration of stay, and nationality of the foreign national in the remarks column of the Notification of Employment Insurance Status (Koyou Hoken Hihokensha Shikaku Shutoku/Soshitsu Todoke).
(2) Notification on Foreign Nationals not covered by Employment Insurance
Indicate the name, residency status, duration of stay, date of birth, gender, nationality etc. in the Report on Employment Conditions of Foreigners (Gaikokujin Koyoujyoukyou Todokedesho)
The deadline of the notification is the last day of the following month for both employment and departures.
For foreign workers already employed at October 1st, notification must be filed within one year after the new legislation is enacted (until October 1, 2008).
Employers who neglect to file a notification or submit a false notification will be faced with a fine of up to 300,000 yen.
